This morning, lawyers on both sides of the fence finished up their oral arguments for the California Supreme Court, where a group of citizens is challenging Proposition 8’s Constitutionality. We’ll know within 90 days how they decide.
After three hours of arguments, it seemed as though the seven justices leaned against voiding the 18,000 same-sex marriages performed last year, but their stance on Proposition 8’s constitutionality was less clear.
They’re grappling with issues such as what “inalienable” means when used to describe a constitutional right; whether such rights can be limited or revoked by an amendment, by a revision or at all; and how majority rule balances with protection of historically disadvantaged minorities’ fundamental liberties. The court will rule within 90 days.
Big issues, but a simple decision: ALL citizens should have EQUAL RIGHTS. There’s no question here.
I hope these justices get their heads on straight and overturn this hateful bullshit.

I agree, Beet. And, I pray that they don’t void the 18,000 marriages because ours would be one of those 18,000. We eloped to San Francisco on July 21. It was the happiest day of my life. There were people sitting in the main hall applauding as newly married couples walked past.
But, no matter what they do decide, they can’t take away the memories of that day.

Actually, the California Supreme Court overturned a voter approved measure in 1966 that would have permitted racial discrimination in housing. The voters in California voted for this meausre by almost a 2 to 1 margin. They declared it was unconstitutional.

State by state is not the way to go. They tried that with universal suffrage and it resulted in women not being given the vote till 1922 (shameful).

Actually, the 19th amendment was ratified in 1920, although Mississippi didn’t formally ratify the amendment until 1984. That’s pretty shameful.

I’m all for anyone who loves each other being able to get married. I don’t really see what the big deal is. But at the same time, this country is a democracy. The people voted, and agree or not, that is how they voted. I don’t want the votes to stop counting and government making all of the decisions for us. If it is an issue of unconstitutionality then the Supreme Court should assess it and make any correction that is necessary. No matter what the personal beliefs, EVERYONE should be adamant that their VOTES MATTER.
Gat marriage isn’t a “right.” Stop pretending it is. With that said, I don’t care who marries who.
I support prop 8 and that’s my rightful opinion. I don’t understand why it’s perfectly okay for people to bash people that support it but not the other way around. I have the freedom to have my own opinion, just as anyone else does. It’s tasteless and just plain rude to call someone a “stupid twat” or worse for thinking differently than you do.
